Welcome to Highway Guardian Towing LLC ("Highway Guardian," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, phone lines, SMS/chat, and dispatch services (collectively, the "Services"). By requesting or receiving towing or roadside assistance through us, you agree to these Terms.

1) What we do

Highway Guardian operates a dispatch platform that connects customers ("you") with independent towing and roadside assistance providers ("Vendors"). We do not own or operate tow trucks. Vendors perform the on-scene services as independent businesses.

2) Quotes, pricing & payment

You'll receive an upfront quote (base, mileage, and any applicable surcharges) before dispatch.

We take a payment authorization before dispatch and capture the final amount upon completion (including any adjustments you approve on-scene).

You authorize us to charge your provided payment method for the service and approved adjustments.

3) Scheduling, arrival times & safety

ETAs are estimates. Traffic, weather, and safety conditions can change. We provide updates via SMS where possible.

Your personal safety comes first. If your situation appears unsafe, we may modify or cancel the job until it's safe to proceed.

Follow all instructions from the Vendor (e.g., move away from traffic) and local authorities.

4) Cancellations & dry runs

You may cancel before dispatch at no cost.

After dispatch, a dispatch fee may apply.

If the Vendor arrives and you/your vehicle are not present or service is refused on scene, a dry-run fee may apply. See our Refund, Cancellation & Dry-Run Policy.

5) Your responsibilities

Provide accurate location details (cross streets/mile markers/landmarks).

Ensure you have the legal right to authorize towing for the vehicle.

Remain reachable on the phone number you provided until the job is complete.

6) Damage claims

Vendors must capture pre- and post-service photos and obtain your signed Bill of Lading (BOL).

Report any damage within 72 hours as described in our Damage Claims Policy.

Vendor insurance is primary for on-scene incidents. We coordinate with you and the Vendor's insurer.

7) Conduct & prohibited uses

You agree not to: (a) submit fraudulent requests; (b) harass or endanger staff or Vendors; (c) misuse the Services, including interfering with operations or attempting to access others' data.

8) Disclaimers

The Services are provided "as is." Vendors are independent contractors and are solely responsible for the on-scene work. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

9) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability to you for any claim related to the Services shall not exceed the fees you paid for the applicable job.

10) Dispute resolution; governing law

These Terms are governed by the laws of New Mexico. Any dispute will be resolved by binding arbitration in New Mexico, except either party may seek injunctive relief in court. You waive class actions and agree to individual arbitration.

11) Changes to the Terms

We may update these Terms from time to time. Updated Terms will be posted with a new "Effective date." Continued use of the Services after updates means you accept the changes.

13) SMS Terms of Service

By providing your mobile phone number and requesting our services, you consent to receive SMS text messages from Highway Guardian Towing LLC for service-related communications.

Types of Messages

We may send you the following types of SMS messages:

  • Service confirmations and dispatch notifications
  • Driver arrival updates and ETA changes
  • Payment confirmations and receipts
  • Service completion notifications
  • Customer service and support messages
  • Informational messages about your towing service
  • Operational updates related to your service request

"If you consent to receive conversational, informational, and operational SMS from Highway Guardian Towing LLC, you agree to receive service-related SMS messages from us."

Opt-Out and Support Instructions

Privacy Protection

"No mobile opt-in or text message consent will be shared with third parties or affiliates."

Your mobile phone number and SMS preferences are protected under our privacy policy. We do not sell, rent, or share your mobile information with third parties for marketing purposes.

Additional Information

SMS messages are supported by major carriers including Verizon, AT&T, T-Mobile, Sprint, and others. Message delivery is subject to carrier network availability and may be delayed.
